BY USING TAXAMBA, YOU AGREE THAT THE PLATFORM OWNER, DEVELOPERS, AND OPERATORS ARE NOT RELIABLE OR LIABLE FOR ANY ERRORS, OMISSIONS, IRS PENALTIES, STATE FINES, INTEREST CHARGES, AUDIT OUTCOMES, OR TAX CALCULATIONS. THIS SOFTWARE IS A SELF-SERVICE AID PROVIDED "AS IS". FINAL RESPONSIBILITY FOR ALL TAX RETURN DATA RESTS ENTIRELY WITH THE TAXPAYER.
1. Acceptance of Terms
By accessing, registering, or using Taxamba (including web applications, mobile interfaces, tax calculation engines, and AI tools), you agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the software.
2. User Obligations & Accuracy of Tax Inputs
You represent and warrant that all financial data, income figures, W-2/1099 inputs, and taxpayer details entered into the platform are accurate, complete, and truthful. You are strictly responsible for maintaining the confidentiality of your account credentials and multi-factor authentication (MFA) credentials.
3. Disclaimer of Warranties & Limitation of Damages
- 3.1 "As-Is" Provision: The software is provided without warranty of any kind, whether express, implied, statutory, or otherwise.
- 3.2 Cap on Damages: To the maximum extent permitted by applicable law, the cumulative liability of the platform parties for any claims arising under these terms shall not exceed the total fees paid by you to the platform in the preceding 12 months (or $50, whichever is greater).
- 3.3 IRS Penalties & Interest: The platform owner and developers shall have zero monetary liability for IRS or state tax penalties, interest accruals, or additional tax liabilities resulting from software usage.
4. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved through binding individual arbitration rather than jury trials or class action lawsuits.
