TAXAMBA IS A SELF-SERVICE AUTOMATED SOFTWARE APPLICATION PROVIDED "AS IS". THE PLATFORM OWNER, DEVELOPERS, OPERATORS, AND AFFILIATES MAKE NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING SOFTWARE ACCURACY, COMPUTATIONAL SUITABILITY, OR ABSOLUTE RELIABILITY FOR INDIVIDUAL TAX SITUATIONS. THE PLATFORM OWNER AND DEVELOPERS SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY IRS PENALTIES, STATE TAX FINES, INTEREST ACCRUALS, AUDIT ADJUSTMENTS, USER DATA ENTRY ERRORS, OR TAX LIABILITIES. YOU (THE TAXPAYER) REMAIN 100% SOLELY RESPONSIBLE FOR VERIFYING ALL FORM 1040 LINE ITEMS PRIOR TO E-FILING OR SUBMISSION.
1. Information We Collect
To provide automated tax return preparation, document OCR extractions, and IRS e-filing capabilities, Taxamba collects necessary taxpayer information provided by you or uploaded through tax forms:
- Taxpayer Identifying Information: Name, Social Security Number (SSN), Individual Taxpayer Identification Number (ITIN), Date of Birth, Occupation, Filing Status, and Mailing Address.
- Income & Tax Documents: Form W-2 wages, 1099-NEC/MISC freelance income, 1099-DIV/INT investments, 1099-B stock/crypto proceeds, Schedule K-1s, 1098 mortgage statements, and deductible expense receipts.
- Device & Security Data: IP address, user-agent details, MFA authentication tokens, and browser fingerprints for fraud prevention and audit trailing required by IRS Publication 4557.
- Visitor Geolocation & Terms Telemetry: For non-registered visitors, we capture City, State, Country, and entry timestamps for security auditing and fraud protection. For registered users, we record complete user profile data and generate a downloadable SHA-256 Certificate of Agreement for Terms of Service acceptance.
2. IRS Section 7216 Non-Disclosure Commitment
Under Internal Revenue Code (IRC) § 7216 and federal regulations, tax return preparers and software providers are strictly prohibited from disclosing or using taxpayer information for purposes other than tax return preparation without explicit written consent.
3. Disclaimer of Warranties & Absolute Non-Liability Statement
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS THE LIABILITY OF THE PLATFORM OPERATORS AND DEVELOPERS.
3.1 No Reliance / Software Offered "As-Is": Taxamba, its owners, operators, software architects, and affiliates (collectively, "Platform Parties") provide this software and all embedded tax calculation engines, AI copilot responses, document OCR extractions, and refund estimators strictly on an "AS IS" and "AS AVAILABLE" basis. The Platform Parties make no representation or warranty that the software calculations will be error-free, completely uninterrupted, or suitable for your specific tax scenario.
3.2 Waiver of Liability for IRS/State Penalties & Audits: UNDER NO CIRCUMSTANCES SHALL THE PLATFORM PARTIES BE HELD RELIABLE, RESPONSIBLE, OR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY IRS FINES, STATE TAX PENALTIES, INTEREST CHARGES, TAX AUDIT ASSESSMENTS, LEGAL FEES, LOST PROFITS, OR INDIRECT DAMAGES RESULTING FROM YOUR USE OF THIS SOFTWARE, SYSTEM DOWNTIME, INACCURATE USER INPUTS, OR CALCULATION DISCREPANCIES.
3.3 Sole Taxpayer Responsibility: Federal law places the legal duty of tax return accuracy squarely on the taxpayer. You acknowledge that you must independently review every line item on Form 1040, Schedule 1–3, and all attached schedules prior to authorizing e-filing or signing your return.
3.4 No Professional Fiduciary Advice: Software features, automated deduction optimizations, AI responses, and scenario modeling tools serve as self-service aids only and do NOT constitute formal CPA, legal, or fiduciary tax advice. Engaging a CPA through the platform creates a separate professional relationship governed by specific CPA engagement terms.
4. Security & Data Encryption Standards
In compliance with IRS Publication 4557 and FTC Safeguards Rules, Taxamba employs multi-layered security controls:
- AES-256 Encryption at Rest: All Social Security Numbers, Employer Identification Numbers, and sensitive financial fields are encrypted prior to database storage.
- TLS 1.3 in Transit: All communications between your client browser, our web application, and S3 document vaults utilize TLS 1.3 encryption.
- Statutory Record Retention: Stored tax returns and e-file XML submission packages are retained for a minimum of 3 years to comply with federal tax recordkeeping requirements.
5. Your Rights & Contact Information
You have the right to request access to your stored tax data, export your tax return documents, or request account deletion (subject to statutory IRS e-file recordkeeping retention laws).
